Being charged with a crime can be devastating both emotionally
and financially. It is the one time that the government is
not supposed to work for you, but works diligently and directly
against you by bringing to bear virtually limitless resources
all aimed at convicting you, taking money from you, and in
many cases sending you to prison.
One of the most common reactions to being arrested
is to feel that there is no hope. You may feel that that your
future is in the hands of the police, the prosecutors, and
the courts. This reaction is wrong. The government
does not get to determine who is guilty and who is innocent.
That decision is left to a jury of your peers and the government
is required to prove your guilt beyond all reasonable doubt.
In contrast, you are not required to prove anything.
Proving guilt can be an extremely difficult
task for the government. Cases are sometimes dropped when
a prosecutor believes she will be forced to take a case to
trial that she cannot prove. Also, because of protections
of individual rights embodied in the U.S. and Florida Constitutions,
criminal law is extremely complex. Law enforcement and prosecutors
are strictly required to follow very specific rules from the
moment they first come into contact with you. They must follow
these rules at every stage of your case. If the government
does not follow the rules, it may be possible to have evidence
thrown out or your case may be dismissed entirely. Your attorney
can help evaluate the facts of your case to determine if any
of these mistakes were made, and that attorney can fight to
hold the government accountable.
